Proposal to make bye-laws amending the National Transport Authority (Public Passenger Transport Services) Bye-Laws 2019 S.I. No. 273 of 2019

Notice is hereby given, in accordance with Section 56A(4) of the Dublin Transport Authority Act 2008, by the National Transport Authority that it proposes to make bye-laws in accordance with Section 56A(1) of the Dublin Transport Authority Act 2008 (the “Bye-Laws”) amending the National Transport Authority (Public Passenger Transport Services) Bye-Laws 2019 (S.I. No. 273 of 2019) (the “2019 Bye-Laws”).

The purposes for which the proposed Bye-Laws are to be made is to remove the inconsistency between the 2019 Bye-Laws and certain provisions the Road Traffic Act 1961 regulating the provision of ancillary public passenger transport services by specifying: 

  • the rules for the boarding and alighting from a large public service vehicle (as defined in the Road Traffic Act 1961) while it is in motion that apply to omnibus’ on a route or portion of a route on which there are stands or stopping places and the rules for all other large public service vehicles; and 
  • the rules for signalling or other indications causing the driver of a large public service vehicle to stop the large public service vehicle for the purpose of enabling a person to board, or to alight from, the large public service vehicle that apply to omnibus’ on a route or portion of a route on which there are stands or stopping places and the rules for all other large public service vehicles.

A copy of the proposed Bye-Laws are available to view at Haymarket House, Smithfield, Dublin 7, D07 CF98 (being the principal offices of the National Transport Authority). The proposed Bye-Laws are also published on the National Transport Authority’s website at www.nationaltransport.ie.

Any person may submit to the national Transport Authority objections to the proposed Bye-Laws in writing at any time on or before the 8th January at 12pm (midday). Such objections should be received by the National Transport Authority at Haymarket House, Smithfield, Dublin 7, D07 CF98 (attention: Chief Executive Officer) or at the following email address: [email protected]
